Petitioner, already in custody, seeks bail in connection with Araria (Mahila) P.S. Case No. 02/2016, registered under Sections 376/34 of the Indian Penal Code.

The allegation in brief is that the informant had acquaintance with the petitioner and on the basis of false allurement of marriage the accused forcefully took the informant in Mahthwa temple and got married with her without her consent and on 27.12.2015 he had taken the victim at his house and established sexual relationship with her continuously and on 08.02.2016 left her and also threatened to kill her. Learned counsel for the petitioner submits according to prosecutrix herself it was a case of elopement and no case was

Patna High Court Cr.Misc. No.12849 of 2018 (2) dt.05-03-2018 2/2 earlier lodged by any of family members of the victim girl and the girl is major.

Having considered the said facts and circumstances, the petitioner, Dinanath Yadav @ Dinannath Yadav, above named, is directed to be released on bail on furnishing bail bond of Rs. 10,000/- ( Ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub Divisional Judicial Magistrate, Araria in connection with Araria (Mahila) P. S. Case No. 02 of 2016.
