2. The petitioner seeks bail in connection with Charpokhri P.S. Case No. 94 of 2025 instituted for the offences under Section 309(4) of the B.N.S.
3. As per prosecution case, three persons arrived at the C.S.P. Centre and, on the pretext of withdrawing money, they took cash Rs. 1,07,130/- and cheque from the cash counter on the gun point. The accused persons also took cash Rs. 2,500/- from the purse of the informant and, thereafter, fled away from there.
4. Learned counsel for the petitioner submits that

No.74370 of 2025(2) dt.10-11-2025 2/3 the petitioner is innocent and has committed no offence as alleged against him and has falsely been implicated in the present case merely on the basis of suspicion. The petitioner is not named in the F.I.R. and his name has transpired in this case on the basis of the confessional statement of the coaccused Ranjeet Kumar recorded before the police which has got no evidentiary value in the eye of law. The co-accused Ranjeet Kumar has already been granted bail by the learned court below itself. He further submits that nothing incriminating has been recovered from the conscious possession of the petitioner. The petitioner has three criminal antecedents and is languishing in judicial custody since 29.07.2025 without any rhymes or reason.
5. On the other hand, learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner.
6. Having heard rival contention of both the parties and considering the entire facts and circumstances of the case as also taking into account the period of custody of the petitioner, let the petitioner, abovenamed, be released on bail
Patna High Court CR. MISC. No.74370 of 2025(2) dt.10-11-2025 3/3 on furnishing bail bonds of Rs.15,000/- (Rupees Fifteen Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Charpokhri P.S. Case No. 94 of 2025.
