JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 20-10-2020 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Initially, the informant filed complaint petition which was converted into police case bearing Barhat P.S.Case No. 421 of 2007 which was investigated by the police and after investigation, police found the case as mistake of fact and submitted final form but the informant of the aforesaid c ase filed a protest petition which was treated as complaint petition and thereafter, learned court below having made inquiry under section 202 of the Cr.P.C took cognizance for the offence punishable under section 354/34 of the Indian Penal Code. Admittedly, petitioner no. 3 is wife of victim and so far as petitioner no. 1 and 2 are concerned, there are in-laws of

Patna High Court CR. MISC. No.69255 of 2019(8) dt.20-10-2020 2/2 the victim. The contents of complaint petition go to show that occurrence is said to have taken place at Kolkata and moreover, it is admitted case of the complainant that after leaving the house, victim started working at Kolkata.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that above named, petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Judicial Magistrate 1st class, Jamui in Complaint case no. 731C of 2013 subject to condition as laid down under Section 438(2) of the Cr.P.C.
