JUSTICE ARUN KUMAR ORAL ORDER 25-01-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody, seeks bail in Patrakarnagar PS Case No. 540 of 2017(Special Case No. 6925 of 2017) registered under Sections 30(a)(b), 38 and 41 of the Bihar Prohibition and Excise Act.

The allegation in brief is that several bottles of foreign liquor in total 36 litres was recovered from the water purifier plant. Learned Counsel for the petitioner submits that Tridiva Dhara water purifier plant is not of the petitioner but of one Kunal and the petitioner has rented the premises to him. Petitioner is in custody since 11.10.2017.

Having considered the said facts and circumstances, the petitioner, namely, Jitendra Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Special Judge, Excise Act, Patna in connection with Patrakar Nagar PS Case No. 540 of 2017.
