JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-02-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 17.7.2017 passed in Cr.Misc.No. 19236 of 2017 on merit with direction to learned trial court to conclude the trial within a period of one year. Submission of learned counsel for the petitioner is that trial has not been concluded and petitioner is in custody for more than two years.

Heard learned APP also.

Having heard both sides and in view of facts and circumstances and considering the fact that petitioner has criminal antecedents also, I am not inclined to grant bail to the petitioner. However, as the petitioner is in custody for more than two years, learned trial court is directed to conduct the trial on day

Patna High Court Cr.Misc. No.7971 of 2018 (2) dt.28-02-2018 2/2 to day basis and try to conclude it within a reasonable period. At the same time, Superintendent of Police, Begusarai is directed to ensure the presence of witnesses in court. It is made clear that if trial court feels necessary to separate the trial of the petitioner from others he may do so and try to conclude the same.
