The petitioner is languishing in custody in a case registered for the offences punishable under Sections 143, 341, 323, 308, 379, 504, 506, 34 of the Indian Penal Code, later on, section 307 I.P.C was also added.
It is alleged by the informant that all the F.I.R named accused persons assaulted the son of the informant and snatched cash of Rs. 10,000/- from his pocket.
It is submitted by learned counsel for the
Patna High Court CR. MISC. No.79070 of 2023(2) dt.14-12-2023 2/3 petitioner that petitioner is innocent and he has falsely been implicated in this case. The informant is father-inlaw of the petitioner and since he had performed love marriage with his daughter, this false case has been registered against him. There is no eye witness to the occurrence. The injured received injury due to road accident. The petitioner is languishing in custody since 22.08.2023. A statement has been made in para 3 of the petition that petitioner is accused in one other case lodged by his wife, apart from the present one. In contra, learned counsel appearing on behalf of the informant and learned A.P.P appearing on behalf of the State have vehemently opposed the prayer for bail of the petitioner.
Considering the facts aforesaid and the period under custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) with two sureties of the like amount each to the satisfaction of learned Chief Judicial
