The petitioner has filed the instant application for grant of bail in connection with Hajipur Sadar P.S. Case No. 428 of 2019 (District Vaishali at Hajipur) registered for the offence under sections 341, 307, 379 and 34 of the Indian Penal Code and section 27 of the Arms Act.

It is submitted by learned counsel for the petitioner that from the FIR itself it would be evident that no overt act has been alleged against the petitioner. It is only on the basis of suspicion that the petitioner and two others including one Ram Babu has been implicated in the instant case. It is further submitted that the case of the petitioner stands on similar footing to that of Ram Babu @Rambabu who has already been

Patna High Court CR. MISC. No.68804 of 2019(2) dt.25-11-2019 2/2 enlarged on bail vide order dated 19.09.2019 in Cr. Misc. No. 59273 of 2019. It is further submitted that the petitioner is in custody since 20.07.2019.

The application for bail has been opposed by learned APP for the State.

Having heard learned counsel for the parties and taking into consideration the above facts including the grant of bail to the similarly situated co-accused, the Court is inclined to enlarge the petitioner on bail. Let the petitioner, above named, be enlarged on bail on his furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Vaishali at Hajipur in connection with Hajipur Sadar P.S.
