JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-03-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 16.5.2017 passed in Cr.Misc.No.23067 of 2017 with a direction to learned trial court to expedite the trial and conclude the same within a period of nine months. Submission of learned counsel for the petitioner is that nine months period has already expired and not a single witness has been examined till date and petitioner is in custody for more than one and a half years and nothing has been recovered from his possession.

In the facts and circumstances, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like
Patna High Court Cr.Misc. No.17586 of 2018 (2) dt.28-03-2018 2/2 amount each to the satisfaction of Additional Sessions Judge-X, Patna, in connection with Sessions Trial No. 816 of 2016, arising out of Phulwarisharif (Janipur) P.S.Case No. 211 of 2016, subject to the conditions that (1) one of the bailors shall be a local person having sufficient immoveable property in the jurisdiction of court concerned and (2) petitioner shall co-operate in disposal of trial and appear on each and every date, except on genuine ground, failing which his bail bond shall be cancelled.
