Petitioners, already in custody, seek bail in Mojahidpur PS Case No. 392 of 2017 registered under Section 379/34 of the IPC. The allegation in brief is that the petitioners committed theft of 1300 rupees from the co-passenger sitting in the tempo but no money was recovered from their possession.

Submission is that the petitioners were apprehended on suspicion and they are in custody since 27.12.2017. Having considered the said facts and circumstances, the petitioner Md. Sonu and Md. Banti @ Jashim are directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) by both of them with two sureties of the like amount each to the satisfaction of CJM Bhagalpur in connection with Mojahidpur PS Case No. 392 of 2017.
