2. The petitioner seeks bail in connection with Laherisarai P.S. Case No. 508 of 2025 registered for the offences under Sections 331(4), 64 and 351(3) of the Bharatiya Nyaya Sanhita.

3. The petitioner is named in the F.I.R. and is in custody since 18.08.2025.

4. As per FIR, petitioner committed rape upon informant, who is a married lady aged about 21 years.

5. Mr. Ajay Kr. Thakur, learned counsel appearing on behalf of the petitioner submitted that being married lady, she was in extramarital affair with this petitioner and when her affair came into knowledge of her husband, present false case was lodged. It is

No.74362 of 2025(2) dt.07-11-2025 2/2 submitted that relation qua love affairs can be easily gathered from the photographs of the petitioner and the informant, which is part of the FIR itself. While concluding the argument it is submitted that, petitioner is a man of clean antecedent.

6. Learned APP appearing on behalf of the State, opposes the prayer for bail.

In view of aforesaid factual submission and by taking note of fact as prima-facie allegation appears as of extramarital affair which also gets it strength from photographs as annexed with FIR itself, coupled with the fact as petitioner remains in custody since 18.08.2025, accordingly above named petitioner, is directed to be released on bail in connection with Laherisarai P.S. Case No. 508 of 2025 on furnishing bail bond of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Darbhanga/concerned court, subject to the conditions as mentioned under Section 480(3) of the B.N.S.S.
