Petitioner, already in custody, seeks bail in connection with Rafiganj P.S. Case No.44 of 2007, registered under Sections 341, 324, 307, 34 of the Indian Penal Code, Section 27 of the Arms Act as well as under Sections 3/4 of the Explosive Substance Act.

Allegation in brief is that three unknown persons shot at the informant while he was going and also exploded bomb. Learned counsel for the petitioner submits that there is no material against the petitioner except his confessional statement before the police, neither he was put on T.I.P. for identification by the informant nor there is any recovery, police has submitted charge-sheet and the petitioner is in custody since

Having considered the said facts and circumstances, petitioner Deo Kumar Sharma is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned CJM, Aurangabad in connection with Rafiganj P.S. Case No.44 of 2007 with conditions that one of the bailors must be the close family member of the petitioner and in case of absence on two consecutive dates before the trial court during trial without any reasonable cause, his bail bond shall liable to be cancelled.
