The petitioners, who are in custody since 25.06.2019, seek bail in connection with Shikarpur P.S. Case No. 51 of 2019 which was initially instituted for the offences under Sections 341, 324, 307, 498A and 505/34 of the Indian Penal Code but later Section 304B of the IPC was also added.

The petitioners are elder brother-in-law and the elder sister-in-law of the deceased respectively. From the

Patna High Court CR. MISC. No.70008 of 2019(2) dt.04-12-2019 2/2 perusal of the FIR which has been lodged by the deceased, it would appear that there is absolutely no allegation against the petitioner no. 1 and with respect to petitioner no.2, the only accusation against her is that she had developed amorous relationship with the husband of the deceased. Taking into account the complete absence of any accusation against the petitioners of any overt act or of harassment of the deceased or of participation in killing the deceased, petitioners, above-named, are directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Bettiah, West Champaran in connection with Shikarpur P.S. Case No. 51 of 2019.
