This application for regular bail arises out of Fatuha P.S. Case No. 567 of 2019 (Special Case No. 7551 of 2019, disclosing the offence under Sections 30(A) of the Bihar Prohibition and Excise Act, 2016.

The petitioner is in custody since 23.08.2019. It has been stated in paragraph-3 of the application that he does not have any criminal antecedent. It is alleged that on the basis of a secret information, the petitioner's cattle shed was raided leading to recovery of 19.6 litres of country made liquor. It appears that recoveries were made from possession of other persons also.

Patna High Court CR. MISC. No.78193 of 2019(2) dt.10-01-2020 2/2 Considering the quantity of liquor said to have been recovered from the petitioner's possession and the fact that the petitioner is in custody since 23.08.2019, this application is allowed.

Let the petitioner, above-named, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand), with two sureties of the like amount each to the satisfaction of learned Special Judge, Excise, Patna, in connection with Fatuha P.S. Case No. 567 of 2019 (Special Case No. 7551 of 2019, subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the court on two consecutive occasions, his bail Bonds shall be liable to be cancelled.
