Petitioners, already in custody, seek bail in connection with Forbesganj P.S. Case No.606 of 2017, registered under Sections 461 and 379 of the Indian Penal Code. Later on Section 411 of the Indian Penal Code was added.
Allegation in brief is that the shop of the informant was broken and Rs.8,50,000/- was stolen. One employee of the shop was apprehended and he made confessional statement and on his disclosure Rs.1,38,000/- was recovered from the house of petitioner no.1 and Rs.1,00,000/- was recovered from the house of petitioner no.2.
Learned counsel for the petitioners submits that the
Patna High Court Cr.Misc. No.9579 of 2018(3) dt.19-02-2018 2/2 petitioners are not named in the FIR. There is no specific material nor any description of the note to suggest that it was stolen one and petitioners are in custody for the last six months approximately and they have no criminal antecedent. Having considered the said facts and circumstances, petitioners, namely, Vijay Kumar Sardar and Kishan Kumar are directed to be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned CJM, Araria in connection with Forbesganj P.S.
