1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 318(4), 352, 74 and 3(5) of the BNS, 2023.
3. The learned counsel for the petitioners, after arguing vehemently for some times realizing his difficulty, seeks permission to withdraw the anticipatory bail application with respect to petitioner no. 4 (Kunti Pandey).
4. Permission is accorded.

It is next submitted that rest of the petitioners are persons with clean antecedent and the informant alleges that on 12.12.2024 at 07:00 AM, Rahul and his wife Kunti, came and said that they intend to sell their house along with the land and also showed two sale deeds by which his wife got the land, the informant became ready to purchase the property and the consideration fixed was Rs. 32 Lakhs, further wife of the informant till 01.02.2025 paid an amount of Rs. 50 Lakhs and the rest amount was to be paid after the sale deed was executed, thereafter, an agreement was entered on stamp paper of rupees one thousand, on which both Rahul and Kunti signed and the date of registration was fixed as 06.06.2025, but the sale deed was not executed and the accused misappropriated an amount of Rs. 30 Lakhs.
6. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is next submitted that from perusal of the allegation as alleged in the FIR, it would manifest that thrust of the allegation is against Rahul and Kunti and the petitioners being father, mother and brother of Rahul came to be implicated with a view to coerce Rahul and Kunti into submission.
7. Learned A.P.P. for the State opposes the prayer for
Patna High Court CR. MISC. No.75617 of 2025(2) dt.20-11-2025 3/3 anticipatory bail of the petitioners.
8. Considering the submissions made by the learned counsel for the petitioners, the petitioner nos. 1, 2 and 3 abovenamed, in the event of their arrest or surrender before the learned trial court within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned trial court where the case is pending/successor court in connection with Muffasil P.S. Case No. 271 of 2025 subject to the conditions as laid down under Section 482 (2) of the BNSS.
9. Accordingly, the instant anticipatory bail application stands allowed.
