Petitioner, already in custody, seeks bail in connection with Matihani P.S. Case No.155 of 2017, registered under Sections 406, 420, 120(B), 504 and 506/34 of the Indian Penal Code. Allegation in brief is that three persons were employed by the SBI, namely, Ajit Kumar Thakur, Raushan Rai and Ravi Shankar Mishra for Grahak Sewa Kendra and it is alleged that they deposited the money of the customers and misappropriated the amount worth Rs.10,00,000/- approximately in association with the other accused persons.
Learned counsel for the petitioner submits that petitioner is not the employee of Grahak Sewa Kendra, allegation against the
Patna High Court Cr.Misc. No.8627 of 2018(2) dt.13-02-2018 2/2 petitioner is that he is involved also but there is no material against him rather he has been implicated being a relative of Ajit Kumar Thakur and similarly situated another co-accused Ranjit Kumar Thakur @ Ranjit Thakur was admitted to anticipatory bail by a coordinate Bench of this Court by order dated 29.01.2018, passed in Cr. Misc. No.3101 of 2018. Having considered the said facts and circumstances as also the fact that specific allegation is against the employee of Grahak Sewa Kendra, petitioner Shiv Shankar Mishra is directed to be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Begusarai in connection with Matihani P.S. Case No.155 of 2017.
