JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 28-02-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Earlier the prayer for bail of the petitioner was rejected by this court vide order dated 20.08.2016 passed in Cr. Misc. No. 34347 of 2016 taking note of this fact that informant's son specifically named the petitioner making allegation that it was petitioner who shot fire on the deceased.
Learned counsel for the petitioner submits that informant's son was examined before the trial court as PW-1 and he stated in his deposition that it was co-accused, Praveen Choudhary, who opened fire on the deceased. He further submits that informant was, too, examined as PW-5 and she also stated that it was co-accused, Praveen Choudhary, who shot fire on the
Patna High Court Cr.Misc. No.7092 of 2018 (2) dt.28-02-2018 2/2 deceased. It is further submitted that co-accused, Deepak Choudhary, having more or less similar allegation, has already been granted privilege of bail by a co-ordinate Bench of this court. Considering the aforesaid facts and circumstances as well as submissions of the parties and also taking note of this fact that petitioner is in jail custody since 19.01.2016 and up till now, his trial could not be concluded, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-IV, Vaishali at Hajipur in connection with Sessions Trial No. 227 of 2015, 318 of 2016 arisng out of Tisiauta P.S. Case No. 72 of 2014.
