2. The petitioner has prayed for bail in a case registered for the offence punishable under Sections 302 and 34 of the Indian Penal Code.

3. It is a case of commission of murder of the informant's uncle namely, Chandan Kumar Singh by the accused persons including the petitioner.

4. Learned counsel appearing on behalf of the petitioner has submitted that petitioner is innocent and has committed no offence. He has been falsely implicated in this case merely on suspicion. There is no specific overt act against this petitioner. The specific allegation is against co-accused Raja

Patna High Court CR. MISC. No.79085 of 2023(2) dt.13-12-2023 2/2 Kumar, Abhishek Kumar and Sanni Kumar along with three unknown and only suspicion has been raised against the petitioner. During investigation, no consistent material has come against the petitioner which shows his involvement in the alleged occurrence. Petitioner is languishing in judicial custody since 26.08.2023.

5. The application for bail is opposed by learned APP for the State.

6. Having heard learned counsel for the parties and considering the facts and circumstances of the case as well as period of custody, this Court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate 1st Class, Saran, Chapra in connection with Nayagaon P.S.
