2. The petitioner has preferred this application for grant of regular bail in connection with Khagaul P.S. Case No. 171/2025 dated 22.05.2025 registered for the offences punishable u/ss 111(4), 111(6) and 111(7) of the B.N.S.
3. As per the prosecution case, the allegation against the petitioner and the co-accused persons is of demanding extortion money from the local builders and businessman as well as forcibly occupying the government and other land of the locality.
4. Learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been implicated in
Patna High Court CR. MISC. No.73957 of 2025(2) dt.16-10-2025 2/3 this case. Nothing has been recovered from the conscious possession of the petitioner. There is general and omnibus allegation against the petitioner. The petitioner has been made accused in this case only because he is the brother of the co-accused, Ritlal Yadav. The co-accused person has already been granted regular bail by this court vide order dated 25.09.2025 passed in Cr. Misc. No. 69623/2025. The petitioner has seven criminal antecedents in which he is on bail as stated in para 3 of the bail petition. The petitioner is in custody since 23.06.2025.
5. Learned A.P.P. for the State has vehemently opposed the bail petition of the petitioner by submitting that the petitioner and the co-accused persons run an organized crime where they acquire huge amount of money through extortion or by forcibly occupying others land.
6. Considering the aforesaid facts and circumstances of the case as well as the period of custody, the petitioner abovenamed, is directed to be enlarged on bail on furnishing bail-bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court concerned, Patna in connection with Khagaul P.S. Case No. 171/2025, with the condition:-
Patna High Court CR. MISC. No.73957 of 2025(2) dt.16-10-2025 3/3 (i). The petitioner is directed to remain physically present before the learned Court below on each and every date, failing which on two consecutive dates without reasonable cause, the bail bonds of the petitioner is liable to be cancelled.
