ANJANA MISHRA ORAL ORDER 04-12-2019 Heard learned counsel for the petitioner and the learned counsel appearing on behalf of the State. The petitioner is in custody since 02.09.2019 in connection with Buxar (Industrial) P.S. Case No.97 of 2019 registered for the offence under Section 30(a) of the Bihar Prohibition and Excise Amendment Act, 2018.

Learned counsel for the petitioner submits that the alleged recoveries were not from the conscious possession of the petitioner, but from the Parti land belonging to one Bateshar Mahto. It is further submitted that the petitioner is also not having any criminal antecedents.

Considering the aforementioned facts and circumstances, let the petitioner, above named, be released on

Patna High Court CR. MISC. No.78269 of 2019(3) dt.04-12-2019 2/2 bail on his furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned A.D.J.-2nd Cum-Special Judge, Excise Act, Buxar, in connection with Buxar (Industrial) P.S. Case No.97 of 2019.
