Petitioner seeks bail in a case registered for the offences punishable under Sections 302/34 and 120B of the Indian Penal Code.

This is a case of misuse of privilege of bail. Submission is that this is first misuse for the reason that the application of the petitioner filed under Section 317 of the Code of Criminal Procedure was rejected by the court below as no one appeared on behalf of the petitioner on call. Considering the aforesaid fact, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where
