2. The petitioner seeks regular bail in connection with Neemchak Bathani P.S. Case No. 192 of 2023 registered for the offences punishable under Sections 147, 148, 149, 341, 323, 504, 506, 379 and 307 of the I.P.C., and under Section 27 of the Arms Act.

3. The prosecution case is to the effect that the accused persons, including the petitioner, all gathered at the house of the informant and started abusing, and they were all heavily armed. Further, it has been stated that the accused, namely Satish Chauhan fired, which hit on the

Patna High Court CR. MISC. No.81478 of 2024(4) dt.01-05-2025 2/3 abdomen of the deceased, namely Sanjay Chauhan. The incident was alleged to be due to a land dispute between the parties.

Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case, and there is a general and omnibus allegation against the petitioner and the specific allegation of firing upon the deceased is on one Satish Chauhan and it has also been corroborated by the perusal of the postmortem report. He further submits that there is admittedly a land dispute between the parties, and hence he has falsely been implicated in this case. He further submits that the petitioner had three criminal cases pending against him; however, he is in custody in the present case since 03.08.2024.

5. Learned APP has vehemently opposed the prayer for bail and states that the petitioner is the named accused in the present case.

6. Considering the aforesaid statements made by the respective parties, taking into account the nature of the

No.81478 of 2024(4) dt.01-05-2025 3/3 allegation, which is general and omnibus, and the period of custody undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the court of learned Judicial Magistrate1st Class, Gaya, in connection with Neemchak Bathani P.S. Case No. 192 of 2023.
