Petitioner, already in custody, seeks bail in Neemchak Bathani PS Case No. 158 of 2017 registered under Sections 186, 212 of the IPC and Sections 25(1-B)a, 26 and 35 of the Arms Act. The allegation in brief is that one Narendra Yadav shot at his brother's wife, thereafter escaped away and later on apprehended from house of the petitioner.

Submission is that except that Narendra Yadav is said to have been given shelter by the petitioner but there is no recovery of arms from the petitioner rather recovery is from Narendra Yadav who is also said to have assaulted with gun to his brother's wife, moreover this petitioner has no criminal antecedent and is in custody since 7.12.2017.

Having considered the said facts and circumstances, the petitioner Sanjay Yadav @ Sanjay Kumar is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of ACJM Xth Gaya in connection with Neemchak Bathani PS Case No. 158 of 2017.
