Petitioner seeks bail in a case registered for the offences punishable under Sections 20, 22, 23 and 24 of the Narcotic Drugs and Psychotropic Substances Act, 1985. 110 gram of opium was, allegedly, recovered from possession of the petitioner.

Submission is that the petitioner is in custody since 19.02.2017. Petitioner has got no criminal antecedent. The investigation is already complete. Moreover, it has not yet been established whether the recovered substance was really opium. The petitioner is ready to cooperate with the trial.

No.13537 of 2018 (2) dt.09-03-2018 2/2 Considering the nature of material and period already undergone, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with N.D.P.S. Case No. 15 of 2017 arising out of Raxaul P.S. Case No. 33 of 2017, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
