The petitioner seeks regular bail in connection with Delha P.S.Case No.103 of 2019 dated 25.4.2019 registered for offences punishable under Sections 457 and 380 of the Indian Penal Code.

FIR discloses allegation of theft in the house of the informant. Petitioner is not named in the FIR and later on accused was arrested and thereafter there is recovery from the petitioner and one co-accused Roshan Kumr.

Submission of the learned counsel for the petitioner is that the recovered articles has never been put on TIP. Petitioner is in custody since 10.5.2019, having no criminal antecedent and recovery is from one Roshan Kumar, who has been granted

Patna High Court CR. MISC. No.73716 of 2019(2) dt.26-11-2019 2/2 bail by Co-ordinate Bench of this Court vide order dated 9.9.2019 passed in Cr. Misc. No.56876 of 2019. Heard learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of the learned ACJM VII, Gaya in connection with Delha P.S.Case No.103 of 2019. With the above direction, this application is allowed.
