JUSTICE PURNENDU SINGH ORAL JUDGMENT Date : 09-01-2024 Heard Mr. Dhananjay Kumar Tiwary, learned counsel appearing on behalf of the petitioner and Mr. Mitihilesh Kumar Singh, learned AC to SC 15 for the State.

Petitioner has filed the writ petition inter alia for following relief(s):- "(I) For directing the respondents to conduct independent enquiry with respect to financial irregularities committed by the Chairman and Members of the Primary Agriculture Credit Society Ltd., West Digha, MakhdumpurDigha Ghat- Patna. (ii) For directing the respondents to take
Patna High Court CWJC No.17628 of 2023 dt.09-01-2024 2/3 appropriate action in terms of order dated 27.01.2022 passed by the District Public Grievance Redressal Officer, Patna and consequential letter No.1705 dated 17.05.2022 issued under the signature of District Cooperative Officer, Patna. (iii) For any other relief/reliefs if petitioner found entitle in the facts and circumstances of the present case."

Learned counsel appearing on behalf of the petitioner submits that the Chairman and some of the executive members of the PACS have allowed private person on rent to use the godown of PACS only for Rs.5,100/- per month in spite of the fact that the District Co-operative Officer vide letter no.1705 dated 17.05.2022 had already directed the Chairman and the executive members of the PACS to take corrective measures.

Considering the grievance of the petitioner, the District Magistrate, Patna is directed to take appropriate action on the basis of the records relating to the concerned PACS and ensure that the godown, which has been built for storing the grains after purchased by the PACS shall not be utilized for any other purpose. The District Magistrate may take steps to redress the grievance of the petitioner within a period of eight weeks and take action against the executive members and the

5. With aforesaid observation and direction, the present writ petition stands disposed of.
