JUSTICE VINOD KUMAR SINHA ORAL ORDER 28-03-2018 Earlier prayer for bail of the petitioner was rejected by this Court vide order dated 12.7.2017 passed in Cr.Misc.No.27350 of 2017 with a direction to learned trial court to expedite the trial and conclude the same within a period of six months and petitioner was given liberty to renew his prayer for bail if trial is not concluded within the said period.

Submission of learned counsel for the petitioner is that six months period has already expired and trial has commenced and three witnesses have been examined and petitioner is in custody since 9.3.2017.

Heard learned APP also.

In the facts and circumstances, let the petitioner, above

Patna High Court Cr.Misc. No.17997 of 2018 (2) dt.28-03-2018 2/2 named, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of Sessions Judge-cum-Special Judge, Muzaffarpur, in connection with Rail (N.D.P.S.) P.S.Case No. 30 of 2017, subject to the conditions that (1) one of the bailors shall be a local person having sufficient immoveable property in the jurisdiction of court concerned and (2) petitioner shall cooperate in disposal of trial and appear on each and every date, except on genuine ground, failing which his bail bond shall be cancelled.
