The petitioner apprehends arrest in a case registered for the offence punishable under sections 419,420,467,468,471 of the Indian Penal Code and sections 66(C) and 66(D) of the IT Act.

As per the prosecution case, police on a secret information, raided a place and arrested co-accused persons who were engaged in on-line cheating the customers by giving them assurance of providing loan etc.

Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. Petitioner's name has figured during course of investigation in confessional statement of co-accused. Petitioner claims clean antecedent. Several similarly situated

Patna High Court CR. MISC. No.74437 of 2022(2) dt.05-05-2023 2/2 co-accused have already been allowed pre-arrest bail by a coordinate bench of this Court vide paragraph 11 of the bail petition.

Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within six weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate, Nalanda at Biharsharif in Giriak (Katri sarai) Police Station Case No. 16/2022, subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
