====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 10-01-2024 Heard learned counsel for the petitioners and the State.
2. Petitioners apprehend arrest in a case registered for the offences punishable under Sections 341, 323, 307, 302/34 of the Indian Penal Code.
3. As per prosecution case, these petitioners assaulted the mother-in-law of the informant by means of rod and spade as a result of which she succumbed to the injuries during the course of treatment. There is specific allegation of assault against petitioner Nos. 1 and 2.
4. Learned counsel for the petitioners submits that
Patna High Court CR. MISC. No.80154 of 2023(2) dt.10-01-2024 2/2 allegation of assault against petitioner No. 3 is general and omnibus. Petitioners claim clean antecedent.
5. Considering the specific accusation of assault, prayer for anticipatory bail of petitioner Nos. 1 and 2 is refused. However, the anticipatory bail with regard to petitioner No. 3 is allowed and it is ordered that the above named petitioner No. 3 in the event of his arrest/surrender before the court below within a period of six weeks from today, be enlarged on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate- IV, Gopalganj in connection with Yadopur P. S. Case No. 119 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
