Petitioner seeks bail in Laukaha P.S. Case No.41 of 2016 instituted for the offence under Section(s) 409 and 420 Indian Penal Code.
Prayer of the petitioner for bail was earlier rejected by this Court by order dated 14.02.2017 passed in Cr. Misc. No.891 of 2017 with liberty to renew the prayer for bail after six months in the event he completes the construction work and produces the certificate from the competent authority with regard to completion of construction of school building. The petitioner has enclosed Annexure-6, which is No Objection Certificate duly signed by the District Programme Officer, from which it appears that all constructions works of the
Patna High Court Cr.Misc. No.7777 of 2018 (3) dt.28-02-2018 2/2 school under financial year 2010-11 and 2011-12 have been completed after lodging of the First Information Report against the petitioners.
In the facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner, above named, be released on bail on furnishing bail bond of `10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate, Jhanjharpur, Madhubanbi, in connection with Laukaha P.S. Case No.41 of 2016, subject to the condition that both the bailors shall be close relative of the petitioner.
