JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 The petitioner seeks regular bail in connection with Sahebpur Kamal P.S. Case No. 18 of 2018, registered for offences punishable under Sections 420, 467, 468, 414, 279, 304(A), 304 and 120 (B) of the Indian Penal Code and Sections 30(a), 32, 27, 41(1) of the Bihar Excise and Prohibition Act. Prosecution case is that more than 3300 litres of liquor was recovered from a truck and 146 and odd litres of liquor was recovered from Bolero vehicle and some of the accused persons arrested, who disclosed the names of petitioner and other as the persons, who were engaged in sell and purchase of liquor. Apart from that it appears that petitioner is accused in three more cases of similar nature.

It has been submitted on behalf of the petitioner that he has falsely been implicated in this case and earlier he was not

Patna High Court CR. MISC. No.74095 of 2019(2) dt.11-12-2019 2/2 accused in this case but after arrest in this case, he has been made accused in three more cases and in all the cases, name of petitioner has transpired on confession of co-accused and he has been in judicial custody since 29.07.2019.

Having heard both sides, considering the facts and circumstances of the case, this application is allowed. Let the petitioner above named, be released on bail on furnishing bail bonds of Rs. 25,000 (Rs. Twenty Five Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge -II Begusarai, -cum- Special Judge, Bihar Prohibition and Excise, Act 2016, Begusarai, in connection with Sahebpur Kamal P.S. Case No. 18 of 2018 subject to the condition that petitioner shall cooperate in disposal of trial and make himself available as and when required by the Trial Court.
