The petitioner seeks bail in connection with Pakribarnwa P.S. Case No. 445 of 2023 instituted for the offence under Sections 147, 149, 341, 323, 386 of the Indian Penal Code.

As per prosecution case, 4-5 persons, including this petitioner stopped one motorcycle and demanded Rs. 5,000/- and on protest, they snatched key of the motorcycle and later on motorcycle key was returned.

It has been submitted on behalf of the petitioner that the petitioner is in custody since 26-09-2023. Petitioner bear two criminal antecedents, as per disclosure made in

Patna High Court CR. MISC. No.78064 of 2023(2) dt.06-12-2023 2/2 paragraph No. 3 of the bail application.

It has been further submitted by the petitioner's counsel that petitioner has been falsely implicated in the present case. In fact, no such occurrence has taken place. Based on previous dispute with the informant, name of the petitioner has been dragged in this case. Amicable settlement has been done between the informant and petitioner.

Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. 7.

Considering the aforesaid facts and circumstances of the case, period of custody of the petitioner and amicable settlement having been done between informant and petitioner, this Court is inclined to grant bail to the petitioner. 8.

Let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Court below/concerned Court in connection with Pakribarnwa P.S. Case No. 445 of 2023.
