JUSTICE VINOD KUMAR SINHA ORAL ORDER 11-12-2019 Petitioner seeks regular bail in connection with Banka P.S. Case No. 339 of 2006 registered for the offence punishable under Sections 147, 148, 149, 323, 324, 325, 307 and 302 of I.P.C. and Section 27 of the Arms Act. As per F.I.R., the petitioner and twenty five other accused persons were assaulted the informant by various arms. Submission of learned counsel for the petitioner is that the dispute with respect to harvesting of the paddy crop. There is a case and counter case between the parties. No specific injury has been attributed any of the accused persons including the petitioner. He is in custody since 18.07.2019. Charge sheet has already been submitted and there is no chance of tempering with the evidence.

Case No. 339 of 2006, subject to the condition that one of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the court concerned.
