The petitioner, who is in custody, seeks bail in connection with Nokha P.S. Case No. 310 of 2017 registered for the offence punishable under Sections 392, 411 and 414 of the Indian Penal Code.
Informant in his written report has stated that on 16.10.2017 when he was returning his house from State Bank of India after withdrawing Rs. 49,500/- three persons boarding on a Pulsar Motorcycle came ahead and surrounded the informant and snatched his bag having Rs. 24000/-. He further stated that on alarm the peoples who were grazing their pets caught two persons. On query they disclosed their names
Patna High Court Cr.Misc. No.22041 of 2018(2) dt.25-04-2018 2/2 as Pappu Kumar (petitioner) and one another Rahul Yadav. Learned counsel for the petitioner submitted that he is innocent and has been falsely implicated in this case. It has further been submitted that nothing has been recovered from the conscious possession of the petitioner and he is in custody since 17.10.2017.
Considering the aforesaid facts that earlier this Court has rejected the bail application of the petitioner with an observation that after completing six months of custody in jail, he can renew his prayer for bail. In view of the above, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of A.C.J.M., Rohtas at Sasaram, in connection with Nokha P.S.
