JUSTICE RAJEEV RANJAN PRASAD ORAL ORDER 25-02-2023 Heard learned counsel for the petitioner and the State. Petitioner in the present case is seeking a direction to the District Magistrate-cum-Collector, Gaya (respondent no.3) to hear and dispose of the Anganwari Appeal No.01/202 (Annexure-5) against the order cancelling the selection of the petitioner as Anganwari Sevika.

Learned counsel for the petitioner has drawn the attention of this Court towards Annexure-5 to the writ application to submit that it is the memorandum of appeal filed before the District Magistrate-cum-Collector, Gaya which is

Patna High Court CWJC No.235 of 2023(2) dt.25-02-2023 2/2 pending consideration for about two years.

Learned counsel for the State submits that this Court may issue an appropriate direction to respondent no.3 to consider the appeal and pass an appropriate reasoned order thereon within a stipulated period.

In the kind of reliefs prayed in this writ application, it is being disposed of with a direction to the District Magistratecum-Collector, Gaya (Respondent no.3) to hear the appeal and dispose it of by a reasoned order within a period of three months from the date of receipt/communication of a copy of this order. The respondent no.3 must consider the appeal within the stipulated period, failing which the petitioner will be at liberty to move this Court for an appropriate order.

If any selection process is initiated during the pendency of the Anganwari Appeal, the same will be subject to result of the decision in this case.
