JUSTICE VINOD KUMAR SINHA ORAL ORDER 20-11-2019 Petitioners seek bail in anticipation of their arrest in connection with Paharpur P.S. Case No. 155 of 2019 registered for the offences punishable under Sections 341, 323, 324, 354B, 308, 379, 504 and 506/34 of the Indian Penal Code. As per FIR petitioners and others came on a Santro vehicle, entered inside the house of the informant in searching of her son Anil and started abusing her. There is allegation against petitioner No.1 that he assaulted by means of rod to the daughter of the informant and also torn her clothes and against petitioner No.2 there is also allegation of trying to set on fire the house.

Submission of learned counsel for the petitioners is

No.73338 of 2019(2) dt.20-11-2019 2/2 that petitioner No.1 is Mediator in the marriage of son of the informant and there was some marriage dispute between the son of informant and his wife and due to that the petitioners have falsely been implicated and injuries are simple in nature. Heard learned APP also.

In view of above facts and circumstances, let petitioners, in the event of arrest or surrender, be released on bail on furnishing bail bonds of Rs.25,000/- (Rupees twenty five thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, East Champaran, Motihari, in connection with Paharpur P.S. Case No. 155 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. and further condition is that one of the bailors of the petitioners shall be a local person having sufficient immoveable property within the jurisdiction of the court concerned.
