The petitioner seeks bail, who is in custody since 20.05.2021 in connection with Jagdishpur P.S. Case No. 169 of 2021 corresponding to G.R.No.2029 of 2021, F.I.R. dated 17.05.2021 registered for the offence punishable under Sections 302,120(B)/34 of the Indian Penal Code and Section 27 of Arms Act.
The prosecution case, in brief, is that on 17.05.2021 at 10.00A.M., the informant's daughter-in-law namely, Seems Devi was returning home from Gonudham Mandir after worshiping, in the meantime, two co-villagers, namely, Pramod Roy and Manish Shukla surrounded my daughter-in-law. Pramod Roy took out pistol from waist and shoot Seema Devi
Patna High Court CR. MISC. No.1239 of 2023(4) dt.20-06-2023 2/2 in the chest due to which she died on the spot. Learned counsel appearing for the petitioner submits that the petitioner has clean antecedent. He has falsely been implicated in the present case. Further submits that the allegation as alleged in the FIR is false and fabricated and the petitioner has not committed any offence as alleged in the FIR. Vide order dated 11.05.2023, a report was called for with regard to the stage of the trial. Report of the learned Trial Court dated 02.06.2023 reveals that all the prosecution witnesses have already been examined and the case is on the stage of Statement under Section 313 of Cr.P.C. Considering the report of the learned Trial Court, I am not inclined to enlarge the petitioner on bail in connection with Jagdishpur P.S. Case No. 169 of 2021 corresponding to G.R.No.2029 of 2021 pending in the court of learned Addl. District and Sessions Judge-IX, Bhagalpur.
Prayer is refused.
However, the learned Trial Court is directed to expedite the trial and conclude the same at the earliest. (Rajesh Kumar Verma, J) Nitesh/- U T
