The petitioner is accused in connection with Complaint Case No. C2-19 of 2018, registered under Section 30(A) of the Bihar Prohibition and Excise Act, 2016.
The accusation is that on seeing the Police party, two persons, who were boarded on the motorcycle started fleeing, but on chase both were apprehended, who disclosed their names as Amar Kumar (Petitioner) and Ranjeet Kumar. On search, 240 bottles, each containing 300 ML Nepali Soufi recovered from the gunny bags, which was being carried by the petitioner and co-accused Ranjeet Kumar.
Learned counsel for the petitioner submits that petitioner
Patna High Court Cr.Misc. No.18020 of 2018(2) dt.29-03-2018 2/2 is not owner of the motorcycle and he was apprehended by the Police mere on suspicion near the place of occurrence. The petitioner has no criminal antecedent is in custody since 11.01.2018.
Having regard to the facts and the circumstances of the case, the petitioner, above named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the Addl. Sessions Judge-II-cum-Special Judge (Excise), Sitamarhi in connection with C2/19 of 2018. (Rajendra Kumar Mishra, J) manish/- U T
