2. The petitioner seeks regular bail in connection with Amdabad P.S. Case No.230 of 2021, registered for the offences punishable under Sections 341, 323, 324, 307, 504 & 34 of the Indian Penal Code.

3. As per the prosecution case, informant is the elder brother of petitioner who has lodged the F.I.R. alleging that the petitioner was playing cards on the eve of Diwali and when the same was protested, the petitioner assaulted the younger brother Satish Mandal and also hit on the head of the informant by sickle causing injury.

4. Learned counsel for the petitioner submits that the petitioner is innocent and has been falsely implicated in this

He further submits that the injury report disclose that injury to the informant was caused by hard and blunt substance and not by sharp cutting weapon, infact the informant sustained injury on his forehead on Chaukhat/ frame of wooden door during the hot discussion in his family and there is no repeated blow to the informant. He also submits that petitioner has no criminal antecedent and he is in custody since 22.07.2023.

5. Learned APP for the State has opposed the prayer for regular bail of the petitioner.

Considering the facts and circumstances of the case and the submissions of learned counsel for the parties and the period of custody, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned J.M. 1st Class, Katihar in connection with Amdabad P.S. Case No.230 of 2021.
