1. Though the present writ petition has been filed for quashing the order dated 01.07.2020, whereby and whereunder the arms license of the petitioner, bearing License No.14 of 1976 has been suspended, as also the Appellate Order dated 12.08.2022, passed by the Commissioner, Kosi Range, Saharsa, in Arms Appeal Case No.32 of 2020, however, at the outset, the learned counsel for the petitioner submits that since the Divisional Commissioner, Kosi Division, Saharsa, has remanded the matter back to the licensing authority with a direction to hear the petitioner and pass a reasoned and a speaking order, the licensing authority i.e. the District

Patna High Court CWJC No.818 of 2023(3) dt.08-10-2024 2/2 Magistrate, Saharsa, be directed to conclude the proceedings of the pending arms case, within a stipulated time frame.

2. Having regard to the facts and circumstances of the case, I deem it fit and proper to direct the District Magistrate, Saharsa, to hear the petitioner and pass a reasoned and a speaking order, in accordance with law, with regard to the aforesaid matter, within a period of six weeks of receipt/production of a copy of this order.

3. The writ petition stands disposed off on the aforesaid terms.
