Petitioner seeks bail in a case registered for the offences punishable under Sections 341/323/504/506/379/34 of the Indian Penal Code and Section 27 Arms Act. The informant is purchaser through registered sale deed from Rajendra Singh, the plaintiff of Title Suit No. 466 of 2012 vide annexure 4. The petitioner is defendant in the suit along with some other defendants. As such, there is bona fide land dispute between the parties. In the aforesaid background, allegation is of attempt to commit injury on the vital part of the body of the informant. However, the informant escaped. The injury report of the informant would reveal that the Doctor has found simple injury caused by hard blunt
Patna High Court Cr.Misc. No.25819 of 2018 (2) dt.01-05-2018 2/2 substance on non-vital part of the body of the informant. Learned counsel for the informant opposed the prayer for bail on the ground that the petitioner has got criminal antecedent.
Considering the background and nature of allegation, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20,000/- (Rupees Twenty Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Bhabua Police Station Case No. 212 of 2018, subject to the condition that the petitioner shall fully cooperate with the investigation and trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.
