This application is filed for modification of order dated 02.09.2019 passed in Criminal Miscellaneous No. 71482 of 2018.
Learned counsel appearing on behalf of the petitioner submits that petitioner has been granted pre-arrest bail on 02.09.2019 passed in Criminal Miscellaneous No. 71482 of 2018 with a direction to surrender before the court below within a period of four weeks in connection with Complaint Case No. 650 of 2017, pending in the Court of learned Judicial Magistrate, 1st Class, Kaimur at Bhabhua, but
Patna High Court CR. MISC. No.74484 of 2019(2) dt.26-02-2020 2/2 due to some unavoidable circumstances, petitioner could not surrender before the court below within the stipulated time. In such view of the matter, let the time to surrender of the petitioner as ordered on 02.09.2019 passed in Criminal Miscellaneous No. 71482 of 2018 be further extended by three weeks from today.
Accordingly, the modification application is allowed and the order dated 02.09.2019 passed in Criminal Miscellaneous No. 71482 of 2018 is modified to the above extent.
