JUSTICE ARUN KUMAR ORAL ORDER 27-04-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 2.1.2018, seeks bail in Kotwali PS Case No. 27 of 2016 registered under Sections 394 of the IPC.

Learned Counsel for the petitioner submits that the only material transpired against the petitioner in the present case is disclosure of his name in the confessional statement of co-accused, however neither any incriminating article has been recovered from his possession nor he was put on TIP and only on the basis of his criminal antecedent the prayer for bail has been rejected. Having considered the said facts and circumstances, the petitioner, namely, Karan Kumar @ Shekhar @ Chhotu is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of CJM Gaya in connection with Kotwali PS Case No. 27 of 2016.
