Patna High Court CR. MISC. No.68620 of 2019(2) dt.25-10-2019 2/3 25-10-2019 Petitioners seek bail in anticipation of their arrest in connection with Alauli P.S. Case No. 395 of 2017, registered for the offences punishable under Sections 147, 447, 353, 504/120 (B) of the Indian Penal Code.
As per F.I.R. petitioners are said to have made encroachment of the government Gair Majarua land and they are made accused along with several other co-accused persons. Submission of the learned counsel for the petitioners is that allegation against the petitioners are false and concocted. They are ready to co-operate in the investigation and inquiry. They are ready to abide by any condition imposed upon them. Heard learned A.P.P. also.
Having heard both sides, considering the above submission, this application allowed. Let the petitioners, above named, in the event of their arrest or surrender before the Court below within six weeks, be released on bail on furnishing bail bond of Rs.25,000/- (Rupees Five Thousand) each with two sureties of the like amount to the satisfaction of learned Learned Chief Judicial Magistrate, Khagaria in connection with Alauli P.S. Case No.-395 of 2017, subject to the condition laid down under Section 438 (2) of the Code of Criminal Procedure and further condition is that one of the bailors of the petitioners shall
