2. The petitioners apprehend their arrest in a case registered for the offence under Sections 341, 323, 307, 448, 506/34 of the Indian Penal Code.

3. As per the prosecution case, on 04.07.2023 at about 5 PM, both petitioners came at the house of informant, armed with lathi and iron rod and started quarreling with informant and his brother. It is further alleged that petitioner no. 2 assaulted with iron rod on the head of brother of informant, due to which, he sustained injury and thereafter, both petitioners threatened to kill all the family members.

4. It is submitted on behalf of petitioners that

Patna High Court CR. MISC. No.80450 of 2023(3) dt.19-03-2024 2/2 informant and petitioner no. 1 are own brothers and due to property dispute, a simple occurrence of Maarpeet took place, in which, both sides sustained injury. There is case and counter case. Petitioners claim clean antecedent.

5. Learned A.P.P. for the State has opposed the bail petition.

6. Considering the backdrop of the case and nature of allegation coupled with the fact that petitioners have got clean antecedent, let the above named petitioners, in the event of their arrest/surrender within a period of six weeks from today, be enlarged on bail on furnishing bail-bonds of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M., Bhojpur at Ara in connection with Agiaon (G) P.S. Case No. 104 of 2023, subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure.
