Mr. Sri Anish Chandra ====================================================== CORAM: HONOURABLE MR. JUSTICE ARUN KUMAR ORAL ORDER 24-04-2018 Heard learned counsels for the petitioners and the State. The petitioners, already in custody, seek bail in connection with Chanpatia P.S.Case No. 335 of 2017 registered under Sections 399 and 402 of the Indian penal Code. Allegation in brief is that on secret information, police raided the place and found the petitioners and others in intoxicating condition and recovered one loaded country made pistol from the possession of petitioner no. 2 and also some foreign liquor kept in the dickey of motorcycle. Submission is that for the offense under the Arms Act and Excise Act, separate two cases were instituted. It is alleged that competitors were planning to commit dacoity, except suspicion raised, there is no other material and has had no such criminal

No.24184 of 2018(2) dt.24-04-2018 2/2 antecedents rather one case under Sections 307 and other allied offences of penal code and petitioner no. 2 prior to this case had no criminal antecedent of Arms Act and Excise Act and there is no recovery from petitioner no. 1 and both are in custody since 12.10.2017.

Having considered the aforesaid facts and circumstances, the petitioners, namely , Md. Sarfuddin Ansari @ Sarfuddin Ansari and Munna Ansari are directed to be released on bail upon furnishing bail bond of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of the learned CJM, Bettiah, West Champaran, in connection with Chanpatia P.S. Case No. 335 of 2017.
