JUSTICE ARUN KUMAR ORAL ORDER 04-05-2018 Heard learned Counsel for the petitioner and the State. Petitioner, already in custody since 2.3.2018, seeks bail in Sasaram Muffasil PS Case No. 211 of 2018 registered under Section 392 of the IPC.
The allegation in brief is that the informant and his one of the friend was robbed by four unknown miscreants and two lakh rupees cash altogether and a pick up van were taken away by the criminals.
Learned Counsel for the petitioner submits that except disclosure of name of the petitioner by co-accused Saurabh Kumar in his confessional statement there is no material against him, up till now neither any incriminating article has been recovered from the possession of the petitioner nor he was put on TIP. It is further submitted that the allegation is that four miscreants looted the informant and his friend whereas in the confessional statement the co-accused stated that nine persons participated in the occurrence, the petitioner is a student and has no criminal antecedent. Having considered the said facts and circumstances, the petitioner, namely, Gopal Krishna Yadav @ Pappu Yadav is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten
