Petitioner apprehends arrest in a case registered for the offence punishable under sections 323, 379, 504, 506, 34 of the Indian Penal Code.

It is alleged that petitioner tried to outrage the modesty of the complainant.

Learned counsel for the petitioner submits that petitioner is own devar of complainant and earlier co-accused Reeta Devi has also filed complaint case number 2112(c) of 2021 against the complainant, and in revenge this false case has

Patna High Court CR. MISC. No.1617 of 2023(2) dt.08-05-2023 2/2 been lodged only with a view to humiliate and harass this petitioner. The entire prosecution case is absurd and highly improbable.

Learned counsel for the State opposes the bail petition of the petitioner.

Considering the aforesaid facts and circumstances of the case, in the event of arrest or surrender within six weeks from today, let the petitioner, as named above, be enlarged on bail on furnishing bail bond of Rs.10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned J.M-I, Patna in connection with Complaint Case No. 7279 of 2021 subject to the conditions laid down under section 438(2) of the Code of Criminal Procedure.
