Mr.Anita Kumari ====================================================== CORAM: HONOURABLE MR. JUSTICE NAWNEET KUMAR PANDEY ORAL ORDER 07-11-2025 Heard the learned counsel for the petitioner as well as the learned Additional Public Prosecutor for the State.

2. The petitioner is seeking regular bail in connection with Nayagaon P.S. Case No. 01 of 2024, registered for the offences punishable under Sections 332, 333, 307,302,353/34 of the IPC.

3. As per prosecution case, the petitioner was amongst the three miscreants, who were fleeing away by Apache motorcycle. It is further alleged that the police chased them and the petitioner, who was driving the said motorcycle dashed one Home guard namely, Sheo Mangal Singh, who died in PMCH, during course of treatment.

4. The learned counsel for the petitioner has submitted that the allegation against him is of rash and negligent driving, resulting in the death of a Home Guard and that he has remained in custody since 12.01.2024. It has further been submitted that his earlier bail application was rejected vide order dated 18.09.2024 passed in Cr. Misc. No. 35699 of 2024, with an observation that

5. On the other hand, the learned APP for the State has opposed the prayer for bail.

6. Considering the above-mentioned facts and circumstances, let the petitioner above-named, is directed to furnish bail bond and on doing so, the court below shall release the petitioner on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-XVII, Chapra in connection with Nayagaon P.S. Case No. 01 of 2024, subject to the following conditions:-

The petitioner shall cooperate in the disposal of trial and make himself available on each and every date till conclusion of the trial and if he fails to do so on two consecutive dates, unless he is prevented by extremely adverse circumstances, the learned court below will be at liberty to cancel the bail bond of the petitioner.
