2. The petitioner is apprehending his arrest in connection with Vishambharpur P.S. Case No. 174 of 2023 for the offence under Sections 323, 498A, 379/34 of the I.P.C. and Section 3/4 of the Dowry Prohibition Act.

3. As per the prosecution story, the informant has alleged that her marriage was solemnized with the petitioner on 13.06.2005 according to Hindu rites and rituals in which Rs. 3,00,000/- (cash), ornaments and other articles were given to the petitioner as gift. Out of their wedlock, two children were born. Thereafter, on instigation of co-accused persons, petitioner solemnized second marriage with one Dhanu Kumari and when the informant opposed the second marriage, the petitioner

Patna High Court CR. MISC. No.79507 of 2024(3) dt.03-03-2025 2/2 driven her out from her matrimonial house along with her children and threatened that until one motorcycle is not given by her father, he will not keep her.

4. Learned counsel for both the parties have submitted that the case has been amicably settled between the parties and the informant - Jirmati Devi is residing happily with her husband in her matrimonial house.

5. Keeping in view the aforesaid facts and submissions made on behalf of learned counsel for both the parties, this Court is inclined to extend him the privilege of anticipatory bail.

6. Let the petitioner be released on bail in the event of arrest or surrender within a period of four weeks from the receipt of this order, on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of like amount each to the satisfaction of learned Chief Judicial Magistrate IV, Gopalganj, in connection with Vishambharpur P.S. Case No. 174 of 2023 subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
